Terms and Conditions

Welcome to BornCares. These Terms & Conditions explain the general terms for using our website, requesting caregiving services, and making a booking. By using our website or requesting our services, you agree to these terms to the extent permitted by applicable law.

1. About BornCares

BornCares provides information and assistance to families seeking home-based caregiving services. Our listed services include:

  • Babysitter and Nanny Services

  • Newborn Baby Care

  • Premature Baby Care

  • Japa Maid and Postnatal Support

  • Special Child Care

Service availability depends on the family’s location, care requirements, schedule, and caregiver availability.

2. Eligibility and Use of the Website

You must provide accurate information when submitting an enquiry or requesting a caregiver.

You agree not to:

  • Provide false or misleading information.

  • Use the website for unlawful purposes.

  • Submit another person’s personal information without appropriate authorization.

  • Interfere with the website’s security or normal operation.

Parents and legal guardians are responsible for making appropriate care arrangements for children.

3. Enquiries and Bookings

Submitting an enquiry through our website, phone, or WhatsApp does not automatically confirm a booking.

A booking is confirmed only after BornCares communicates acceptance and the relevant service details have been agreed upon.

Before the service begins, the family should confirm:

  • Type of care required.

  • Caregiver availability and proposed start date.

  • Working hours and service duration.

  • Duties and responsibilities.

  • Total charges and payment terms.

  • Any applicable cancellation, replacement, or refund conditions.

BornCares may request additional information to understand the family’s requirements and assess whether a suitable service option is available.

4. Caregiver Availability and Assignment

Caregiver assignments depend on availability, experience, location, schedule, and the requirements shared by the family.

We will communicate the available options and relevant details before confirming a placement.

A particular caregiver cannot be guaranteed unless this has been expressly confirmed in writing. Any request to change a caregiver is subject to availability and the applicable service agreement.

5. Scope of Caregiving Services

The duties included in a service must be agreed upon before the booking begins.

Depending on the service, duties may include:

  • Supervising and caring for a child.

  • Supporting everyday hygiene and nappy changing.

  • Helping maintain a child’s usual routine.

  • Supporting feeding routines as instructed by the parents.

  • Providing agreed non-medical newborn care.

  • Providing agreed non-medical postnatal household support related to the mother and baby.

Household cleaning, cooking, medical procedures, medication administration, specialized nursing, and other additional duties are not automatically included. These requirements must be discussed and confirmed in advance, subject to the caregiver’s qualifications and applicable requirements.

6. Newborn, Premature Baby and Special Child Care

Families must explain any important care instructions, allergies, mobility needs, communication requirements, feeding instructions, or other relevant information before care begins.

Caregivers do not replace qualified doctors, nurses, therapists, or other healthcare professionals. Services involving premature babies or children with specialized needs must be discussed in advance with BornCares and, where appropriate, the child’s healthcare provider.

Families should seek qualified medical assistance for medical emergencies or health concerns.

7. Family Responsibilities

The family receiving care agrees to:

  • Provide accurate information about the child and care requirements.

  • Explain the child’s routine and relevant safety instructions.

  • Provide necessary supplies and equipment unless otherwise agreed.

  • Ensure the home environment is reasonably safe for the caregiver and child.

  • Communicate any changes to the schedule or care instructions promptly.

  • Treat the caregiver respectfully and provide suitable working and rest arrangements.

  • Pay agreed charges according to the confirmed payment terms.

  • Report concerns about the service to BornCares as soon as reasonably possible.

Families should not ask caregivers to perform duties outside the agreed scope or beyond their qualifications.

8. Pricing and Payments

Service charges depend on the type of care, duration, schedule, location, responsibilities, and the terms confirmed for the booking.

The final price, billing period, payment schedule, and any additional charges must be communicated and agreed upon before the service begins.

Any prices displayed on the website are subject to the specific terms shown with those prices. Please contact BornCares for a current quotation.

No additional charge should be assumed unless it has been communicated and agreed upon or is otherwise permitted by applicable law.

9. Cancellation, Rescheduling and Early Termination

Families should contact BornCares as soon as possible if they need to cancel, reschedule, shorten, or extend a booking.

The applicable notice period, charges, and refund eligibility must be confirmed in the booking agreement or written cancellation policy.

If BornCares cannot provide an agreed service, the available alternatives and any applicable refund or adjustment will be handled according to the agreed terms and applicable law.

Before publishing: BornCares should add its actual cancellation notice period and any valid, clearly disclosed cancellation charges.

10. Caregiver Replacement and Refunds

If a family is dissatisfied with an assigned caregiver or a caregiver becomes unavailable, the family may contact BornCares to discuss the issue and request assistance.

Any replacement will depend on availability, the circumstances, and the applicable booking terms.

Refund eligibility, processing timelines, deductions, and other conditions must be set out in the written refund policy or booking agreement and communicated before payment.

Nothing in these terms removes any consumer rights that cannot lawfully be excluded.

11. Safety and Emergencies

The safety of children, families, and caregivers is important.

Families should provide emergency contact details and communicate relevant safety instructions before care begins. In an emergency, contact the appropriate emergency services or healthcare professional immediately and notify BornCares when it is safe to do so.

Any safety concern, suspected misconduct, or serious service issue should be reported promptly so it can be reviewed.

12. Caregiver Verification and Service Information

BornCares may describe its caregiver selection, interview, training, or background-verification processes on the website.

The precise checks and training applicable to an individual caregiver should be confirmed with BornCares. Website descriptions should accurately reflect the checks actually performed.

Families may request relevant information about the proposed caregiver before confirming a booking, subject to applicable privacy requirements.

13. Privacy and Personal Information

BornCares may collect information provided through enquiries and bookings, such as names, contact details, service location, preferred schedule, and relevant caregiving requirements.

This information should be used only for legitimate purposes such as responding to enquiries, arranging services, communicating with families, processing bookings, and meeting applicable legal obligations.

Personal information should be handled in accordance with BornCares’ Privacy Policy and applicable Indian law.

Please avoid sending unnecessary sensitive information through public website forms or unsecured communication channels.

15. Limitation of Responsibility

BornCares will handle its responsibilities in accordance with the confirmed service agreement and applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, or removes a consumer’s statutory rights.

Any specific allocation of responsibilities between BornCares, a family, and a caregiver should be clearly documented in the relevant service agreement.

16. Complaints and Customer Support

If you have a question, complaint, or concern about a booking or service, contact BornCares using the details below.

BornCares should publish its designated grievance contact or officer details where required by applicable law.
